Cancellation Policy / Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, takes possession of the goods, or in the case of partial deliveries, the last delivery.
To exercise your right of withdrawal, you must inform Meraki Atelier Melina Neumer, Neusser Landstraße 122, 50769 Cologne, Germany, Phone: +49 176 83512337, Email: info@meraki-atelier.de of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post, fax, or email). You may use the attached model withdrawal form, but it is not obligatory.
Upon exercising your right of withdrawal, Meraki Atelier will promptly confirm receipt of your withdrawal (e.g., via email).
To meet the withdrawal deadline, it is sufficient that you send your communication concerning your exercise of the right of withdrawal before the withdrawal period expires.

Effects of Withdrawal
If you withdraw from this contract, Meraki Atelier will refund all payments received from you, including delivery costs (except for additional costs resulting from choosing a type of delivery other than the least expensive standard delivery offered by Meraki Atelier), without undue delay and at the latest within fourteen days from the day on which the notification of your withdrawal reaches us.
Meraki Atelier will use the same payment method used in the original transaction, unless expressly agreed otherwise with you. In no case will you incur any fees as a result of this reimbursement.
Meraki Atelier may withhold reimbursement until the goods have been returned or until you have provided proof of having returned the goods, whichever occurs first.
You must return the goods without undue delay and no later than fourteen days from the day on which you notify Meraki Atelier of your withdrawal from this contract.
The deadline is met if you send the goods before the period of fourteen days expires.
You are responsible for the direct costs of returning the goods in the event of withdrawal.
Meraki Atelier does not bear the costs of return shipping. These costs range from €20.00 to €200.00, depending on the size of the artwork.
You are only liable for any diminished value of the goods resulting from handling them in a way that is not necessary to inspect their nature, characteristics, and functioning.

Preamble

These Terms and Conditions (hereinafter "T&Cs") regulate the contractual relationship between you (hereinafter "Buyer", "You") and the seller, Meraki Atelier Melina Neumer (hereinafter "Meraki Atelier"), in a binding, transparent, and fair manner. The purchase of artworks, paintings, and other items (hereinafter "Goods", "Products", "Works") is governed by these T&Cs. By placing an order with Meraki Atelier, you acknowledge and accept these T&Cs and confirm their incorporation into the purchase contract.

These T&Cs apply to purchases made via the online catalog of Meraki Atelier.
The displayed products are intended solely for consumers purchasing for personal, non-commercial, or non-professional purposes.

§1 Scope

These T&Cs are part of the contract between Meraki Atelier Melina Neumer, Neusser Landstraße 122, 50769 Cologne, Germany, and the Buyer.

Meraki Atelier provides services and deliveries exclusively under these T&Cs.

§2 Conclusion of Contract & Delivery

2.1 By placing an order, the Buyer confirms that they are acting for personal purposes only.
2.2 Contracts via https://www.meraki-atelier.de are concluded exclusively in German.
2.3 Orders and deliveries outside Germany are accepted from the following countries: Belgium, Bulgaria, Denmark, Estonia, Finland, France, Greece, Ireland, Italy, Croatia, Latvia, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Norway, Austria, Poland, Portugal, Romania, Sweden, Switzerland, Serbia, Slovakia, Slovenia, Spain, Czech Republic, Ukraine, Hungary, United Kingdom, Cyprus.
2.4 The presentation of products on the website (including artworks displayed in the online shop) is non-binding and constitutes an invitation to make an offer, not a legally binding offer.
2.5 The Buyer first adds selected items to the cart. They can modify the cart or proceed to checkout by clicking the "Checkout" button. During checkout, all required data for order processing is collected. Before finalizing the order, a summary of order and contract details is displayed. The Buyer can review and correct their details before submitting the order.
The order is a binding offer to purchase the items, which becomes a binding contract once Meraki Atelier sends a confirmation email to the Buyer’s provided email address.
2.6 Meraki Atelier is only obliged to deliver from its own stock. Delivery times are business days, Monday to Friday, excluding public holidays.
2.7 Delivery times indicated on product pages are non-binding.
2.8 Goods are delivered to the address provided by the Buyer, unless otherwise agreed. For PayPal payments, the PayPal account’s registered address is authoritative. The Buyer is liable for additional costs caused by incorrect delivery information, unless the Buyer is not at fault.
2.9 If self-pickup is agreed, the Buyer will be notified when the goods are ready. No shipping costs apply.
2.10 Meraki Atelier reserves the right to reject or cancel orders generated by automated programs, bots, or third-party services.

§3 Prices & Retention of Title
​
3.1 Meraki Atelier is recognized as a small business under §19 UStG and is not subject to VAT. All prices are net prices. Goods remain the property of Meraki Atelier until full payment.
3.2 Shipping costs are not included and are added to the order price. See §4 for details.
3.3 Gift vouchers (€25, €50, €100) can be purchased and are shipped free of charge.
3.4 Custom orders can be requested via the website contact form or by phone.

§4 Shipping Costs
​
4.1 Shipping is free within Germany. For international shipping outside Germany, €20 applies. For artworks over 100 cm in length, shipping via freight forwarder is €200.
Return instructions: For exercising the right of withdrawal, retain the packaging. Return costs range from €30–€200, depending on artwork size.

§5 Payment
​
Meraki Atelier may restrict or offer alternative payment methods. Only payments from EU accounts are accepted. Transaction fees are borne by the Buyer.

5.1 Available payment methods: Prepayment (Klarna), PayPal, Invoice (Klarna)

§6 Warranty & Transfer of Risk
​
6.1 Statutory warranty rights apply for defective goods.
6.2 Obvious transport damage must be reported immediately.
6.3 No warranty for fading or water resistance unless explicitly stated.
6.4 Minor deviations in color or description are not defects if within normal commercial limits.
6.5 Limitation period: 24 months for consumers, 12 months for business customers.
6.6 For merchants, HGB rules apply.

§7 Liability Limitation
​
7.1 Statutory warranty rights apply unless otherwise stated in §6.
7.2 Liability is limited to intentional or grossly negligent acts, except for injury to life, body, or health.
7.3 Foreseeable damages typical of the contract are covered; indirect or lost profits are generally excluded.

§8 No Rights Granted
​
Purchase only conveys ownership of the goods. No reproduction or other use is permitted unless legally allowed.

§9 Data Processing
​
All data processing follows EU GDPR. See the Privacy Policy.

§10 Governing Law
​
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

§11 Right of Withdrawal / Cancellation Policy

You have the right to withdraw from this contract within 14 days without giving reasons.

​
