Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, has taken possession of the goods, or in the case of partial deliveries, the last partial delivery.

You may use the attached model withdrawal form, but this is not mandatory.
After exercising your right of withdrawal, I will confirm receipt of your withdrawal without delay (e.g., by email).
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, I will reimburse all payments received from you, including delivery costs (with the exception of additional costs arising if you chose a type of delivery other than the least expensive standard delivery offered by me), without undue delay and at the latest within fourteen days from the day on which I receive notification of your withdrawal from this contract.
The reimbursement will be made using the same means of payment that you used for the initial transaction, unless expressly agreed otherwise. You will not incur any additional fees as a result of the reimbursement.
I may withhold reimbursement until I have received the goods back or until you have provided proof that you have returned the goods, whichever occurs first.
You must send back or hand over the goods without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal from this contract.
The deadline is met if you send back the goods before the period of fourteen days has expired.
You will bear the direct cost of returning the goods.
Depending on the size and nature of the artwork, return costs range between €50 and €200.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Preamble
These Terms and Conditions govern the contractual relationship between Meraki Atelier – Melina Neumer and its customers for the sale of artworks and design objects as well as for interior design services.
§1 Scope of Application
These Terms and Conditions apply to all contracts between

(hereinafter referred to as “Meraki Atelier”, “I”, or “me”)
and my customers (hereinafter referred to as “customer”).
These Terms and Conditions apply to both:

the sale of artworks and design objects via the online shop, and
-
interior design services provided online or on-site .
My offers are directed at both consumers (§13 BGB) and entrepreneurs (§14 BGB).
Deviating terms and conditions of the customer shall not apply unless I have expressly agreed to them in writing.
§2 Subject of the Contract
Meraki Atelier offers in particular the following services:

Sale of artworks, paintings and design objects

Online interior design concepts (digital flat-rate services)

Full-service interior design services, in particular:

consultation
-
concept development
-
design and planning services
-
project-related services supporting implementation

2.1 The specific scope of services results from the respective product description, individual offer, or written agreement.
§3 Conclusion of Contract
3.1. Online Shop (Art & Design Objects)
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.
A contract is concluded as soon as I accept the order through an order confirmation or shipping confirmation sent by email.
3.2. Interior Design Services
A contract for interior design services is concluded through written acceptance of an offer (e.g. via email) or through booking via the website.
§4 Prices & Small Business Regulation
4.1 Meraki Atelier applies the small business regulation according to §19 UStG (German VAT Act).
No VAT is charged or shown. All prices are final prices.
4.2 Unless otherwise stated, the prices apply to the goods or services described.
Services are invoiced according to individual agreement or offer.
§5 Payment Terms (Services)
1. Online Interior Concept
Flat rate: €680

100% advance payment

Services begin only after receipt of payment
2. Full-Service Interior Design

50% deposit upon contract conclusion

50% remaining payment after presentation of the concept
Invoices are due within 7 days, unless otherwise agreed.
I reserve the right to withhold services until full payment has been received.
§6 Online Shop: Shipping, Ownership & Special Provisions
6.1. Retention of Title
The delivered goods remain the property of Meraki Atelier until full payment has been received.
6.2Shipping and Delivery
Shipping is made to the delivery address provided by the customer.
Delivery times are non-binding unless expressly agreed otherwise.
Shipping costs are shown separately during the ordering process.
For artworks with special dimensions or weight, shipping may be carried out by a forwarding agent.
6.3 Gift Vouchers
Gift vouchers with values of €25, €50 and €100 can be purchased via the online shop.
Shipping of vouchers is free of charge.
6.4Artworks & Unique Pieces
Unless otherwise stated, the artworks offered are handmade unique pieces or limited works.
Minor variations in color, structure, or material are inherent to the artistic process and do not constitute defects.
Images are for illustration purposes; color deviations may occur due to display settings.
6.5Custom-Made Works
Individual custom commissions can be requested via the contact form or by email.
According to §312g (2) No.1 BGB, the right of withdrawal does not apply to goods made to the customer's specifications.
§7 Right of Withdrawal
7.1 Goods
Consumers have a statutory right of withdrawal for distance selling contracts.
Details can be found in the separate withdrawal policy.
7.2 Services
The right of withdrawal expires prematurely if:
-
the customer explicitly agrees that I begin providing the service before the withdrawal period expires, and
-
the customer confirms that they are aware that their right of withdrawal expires upon full performance of the contract (§356 para. 4 BGB).
§8 Project Cancellation (Services)
8.1 If the customer cancels an interior design project after the project has started, the deposit will not be refunded.
8.2Additional services will only be charged if they have already been performed.
8.3 If the customer cancels the project before the project start, no additional costs arise.
§9 Customer Obligations
9.1 The customer agrees to provide all information, documents, and decisions required for the project in a timely manner.
9.2 Delays caused by missing or late cooperation are not the responsibility of Meraki Atelier.
§10 Copyright & Usage Rights

All works created by me (e.g. concepts, designs, plans, visualizations) are protected by copyright law.

The customer receives a simple, non-transferable right of use, exclusively:
-
for the agreed project
-
for their own private or commercial use (e.g. Airbnb)
-
Passing the concept on to craftsmen or contractors for implementation is permitted.
-
In particular, the following are not permitted without my explicit consent:

resale
-
publication
-
reproduction
-
use for other projects
§11 Warranty & Defects

Statutory warranty rights apply.

If goods are delivered with obvious transport damage, I kindly request prompt notification. Failure to report does not affect statutory rights.

Material-related variations or natural aging processes of artworks do not constitute defects if the agreed quality is not significantly impaired.

For entrepreneurs, the limitation period for defect claims is 12 months from transfer of risk, insofar as legally permissible.
For consumers, statutory limitation periods apply.

For entrepreneurs, the duty to inspect and notify defects according to §377 HGB applies.
§12 Liability

I am fully liable for intent, gross negligence, and injury to life, body, or health.
-
In cases of simple negligence, I am liable only for breach of essential contractual obligations; liability is limited to foreseeable damages typical for the contract.
-
Towards entrepreneurs, liability for indirect damages, consequential damages, or loss of profit is excluded as far as legally permissible.
-
No specific economic or design outcome is guaranteed based on my concepts.

§14 Applicable Law & Contract Language

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
